The NYPD said an 18-year-old male has been arrested following a rape of a 17-year-old girl in the Throggs Neck section of The Bronx.

Police said that on Sunday, June 14, at around 10 p.m., the 17-year-old female victim was inside Ferry Point Park in the vicinity Emerson Avenue and Harding Avenue, when she was sexually assaulted by an unidentified person. “The victim fled the scene and was transported by private means to a local area hospital for treatment,” an NYPD spokesperson said.

Pursuant to an ongoing investigation, on June 24, police said James Whiskey, 18, from the Edenwald section of The Bronx was arrested the same day at 10.05 p.m. in the confines of the 45th Precinct, which covers the northeastern section of the Bronx and contains six miles of park area, 10.6 miles of waterfront, Co-op City and City Island.

They said Whiskey was charged with rape and sexual abuse. He is presumed innocent unless and until convicted in a court of law.

According to the criminal complaint, a copy of which was obtained by Norwood News from the Bronx District Attorney’s office, Whiskey is charged with three felony assaults, rape in the first degree, sexual abuse in the first degree, and rape in the first degree, as well as two misdemeanors, sexual abuse in the second degree and sexual misconduct. If convicted of all charges, the defendant will be required to provide an DNA sample that will be permanently entered into the State’s DNA database.

According to the criminal complaint, Whiskey is alleged to have engaged in vaginal sexual contact with [the victim] by forcible compulsion; subjected [her] to sexual contact by means of forcible compulsion; engaged in vaginal sexual contact with [her] without [her] consent, where such lack of consent was by reason of some factor other than incapacity to consent; subjected [her] to sexual contact, where [she] was incapable of consent by reason of a factor other than being less than seventeen years old, and engaged in vaginal sexual contact with her without her consent.

According to the criminal complaint, police were informed by the victim that Whiskey allegedly broadly said to her: head or f*ck? The NYPD was further informed by the victim that she told Whiskey that she did not want to have sex with him, and that he allegedly pulled her by the arms into the park’s parking area near a van. The NYPD was further informed by the victim that Whiskey allegedly held the victim’s arms with one hand and allegedly began to pull down the victim’s pants with the other.

According to the criminal complaint, the NYPD were further informed by the victim that Whiskey allegedly broadly said to her: Help me or you’re dead. They were further informed by the victim that the victim began to yell for help and that Whiskey allegedly covered her mouth with his hand, and allegedly inserted his penis into her vagina without her consent, while allegedly continuing to hold her arms with one hand and while covering her mouth with the other hand.

According to police, in an interview before which his rights had been read to him, Whiskey, broadly said the following, in part:

We saw girls on the train; they were leaving the train. They thought one looked good. He went up to her and stopped the train. He got her details, like number or IG. He was trying to set up a two-men, like a double-date, where he comes, I come. We took an Uber; he paid. Multiple Ubers because there’s multiple parks. Yeah, that was her, the girl I was talking to. I was convincing her, like, your friend’s doing that, that, that. I was trying to get on the same timing. She pulled her pants down, I was recording back shots from behind. She wasn’t on her knees. She was a little tall so I had to tippy toe. She was up on the car. I recorded on her phone, didn’t use protection.

The presiding judge did not set bail during Whiskey’s arraignment and he is due back in court in July.
