Bronx District Attorney Darcel D. Clark announced Aug. 20 that a Bronx man was charged with second-degree 2017 murder following the fatal shooting of a Bronx mother of four while she was walking home in the West Farms section of The Bronx.
“This defendant allegedly opened fire on a public sidewalk killing a mother whose four sons were waiting for her to return home with dinner,” Clark said. “This defendant’s alleged actions demonstrate a callous disregard for human life and resulted in the tragic death of an innocent bystander.”
She said the defendant, Jonathan Odenthal Diaz, 31, was arraigned Aug. 20 on the charge of second-degree murder before Bronx Supreme Court Justice Darlene Goldberg. He was remanded and is due back in court on Nov. 13.
According to the investigation, at around 5:30 p.m. on Jan. 6, 2017, Odenthal Diaz allegedly fired multiple shots near Boston Road and East Tremont Avenue in the West Farms neighborhood. Cindy Diaz, 48, was walking back to her home after purchasing meals from a fast-food restaurant for her children.
The court heard that Odenthal Diaz allegedly shot her once in the chest and once in the arm. She was not the intended target. The victim was rushed to St. Barnabas Hospital where she died from her injuries.
The case is being prosecuted by Senior Homicide Counsel Karl Miller, under the supervision of Burim Namani, deputy chief of the Homicide Bureau, Christine Scaccia, chief of the homicide bureau, and under the overall supervision of James Brennan, deputy chief of the trial division and Theresa Gottlieb, chief of the trial division.
Clark thanked the Southern District of New York for their assistance in the investigation, as well as NYPD Detective Robert Cintron of the Bronx Homicide Division and NYPD Detective Andrew Nash of the 48th Precinct Squad.
The defendant is presumed innocent unless and until convicted in a court of law.
